What is Form 35

Introduction

 

Form 35 is available for use to any assessee / deductor aggrieved by an order of the Assessing Officer (AO). In such a case, the appeal can be filed against the order of the AO before the Commissioner of Income Tax (Appeals) using Form 35. e-filing of Form 35 has been made mandatory for persons for whom e-Filing of return of income is mandatory. For persons for whom e-Filing of Return of Income is not mandatory, Form 35 can be filed either in electronic form or paper form. An appeal is required to be filed along with Memorandum of Appeal, statement of facts and the grounds of appeal and should be accompanied by a copy of the order appealed against and the notice of demand

 

Who needs a Form 35: Notice of Termination on Agreement of Hire Purchase?

 

This Notice is to be completed by the parties who previously signed the car hire-purchase/lease/hypothecation agreement and now want to terminate the agreement on the basis of mutual consent.

Remember that only a vehicle owner can apply for making a new entry in the car registration certificate.

What is Form 35: Notice of Termination on Agreement of Hire Purchase for?

 

To apply for the changing a registration entry, a car owner should contact the Regional Transport Officer. This document is to be made in a duplicate. One copy must be accompanied with the registering authority’s endorsement and need to be returned to the financier after the entry in the certification of registration is made.

Is Form 35: Notice of Termination on Agreement of Hire Purchase accompanied by other forms?

 

The termination process can be finished only after all of the following documents are filed:

  • Registration Certificate

  • Insurance Certificate

  • No objection certificate from Financier

  • Valid Tax

  • Valid Pollution under Control Certificate

So this Notice can be considered only as a part of the document package needed.

When is Form 35: Notice of Termination on Agreement of Hire Purchase due?

There is no particular due dates to file the notice. It can be completed and signed whenever the parties to the original agreement want to terminate it.

 

How do I fill out Form 35?

 

The following information must be provided in order to complete the document:

  • The number of Certificate of Registration of Vehicle must be provided;

  • Name of the registering authority and parties to the agreement;

  • Name, signature, and address of the financier;

  • Name and a signature of the registered owner.

 

Where do I send Form 35?

 

Once completed, an authorized copy of this document should be kept by all parties to the original agreement and registering authority for their personal records.
