Spice Board Registration {as Exporter of Spices (CRES)}

 

Overview:

The Spices Board {Ministry of Commerce and Industry, Government of India} is an organization that works to develop and promote Indian Spices globally. The Board serves as a link between the Indian exporter of spices and the importers abroad. Additionally, the Spices Board is the driving force behind the activities for excellence of Indian Spices and the achievements of every segment of this industry.

The Spices Board is the regulatory body of the Government of India that promotes Indian Spices in the global market. The body was constituted in 1987 with the merger with former Cardamom Board 1968 and Spices Export Promotion Council, 1960. The responsibility of the Board is to provide supervision on the development and promotion of Cardamom and 52 other spices listed in the Schedule of the Spices Board Act, 1986.

Furthermore, the Board is responsible for granting certificate to the person or entity who wishes to involve in or start a work that includes spices. Also, the Board issues the Certificate of Registration as Exporter of Spices {CRES} under section 11 of the Spice Board Act, 1986.

Importance of Spice Board Registration

Having a certificate of registration with the Spice board is necessary for anyone who is dealing with export of spices. Also, the Spices Board Act, 1986 states that "No person shall, after the commencement of this Act, commence or carry on the business of export of any spice under and in accordance with a certificate. Provided that a person is carrying on the business of export of spices immediately before the commencement, and if he has made an application for such certificate with the said period of three months till the disposal of such application."

Functions of the Spice board

The Spices Board has numerous roles and responsibilities and serves as the apex body for licensing and registration of entities and individuals who wish to work involving spices. The following are the responsibilities of the Spices Board;

  • Post-harvest improvement of all types of spices

  • Research, development, and regulation of domestic marketing of Large and Small cardamom

  • Promoting organic production, processing, and certification of spices

  • Working for the development of Spices in the North Eastern States

  • Providing quality evaluation services

  • Promoting export of all spices through

  • Technology up-gradation

  • Quality up-gradation

  • Brand promotion

  • Research and development

 

Responsibilities of the board dedicated to promoting Export of Spices from India includes;

  • Quality certification & control

  • Registration of exporters

  • Documentation and collection of trade information

  • Providing inputs to the Central Government on policies related to Import and Export of Spices

 

Who Should Obtain CRES?

Any person who is either a Manufacturer Exporter or a Merchant Exporter of the 52 scheduled spices and Cardamom shall obtain the Certificate of Registration as Exporter of Spices(CRES) from the Spice Board.

How long is the CRES valid?

  • Certificate of Registration as Exporter is issued for a block period of “three years” notified by the Board from time to time.

  • The Certificate should be renewed at the end of every block year

 

Documents needed for the registration:

 

  • IE Code from the Director-General/Joint Director General of Foreign Trade office situated in your operation/business area.

  • Confidential Report from your operating Bank as per the format provided with the application form.

  • CGST certificate from the tax authorities

  • In case of registration is required as a Manufacturer exporter, that person needs to get the PAN card as well as an SSI certificate or Certificate from the Industries Department as a manufacturer

 

Procedure for Obtaining Certificate of Registration as Exporter of Spices {CRES}

 

You just need to follow these steps to obtain your Certificate of Registration as Exporter of Spices {CRES};

  • The applicant needs to fill and submit the prescribed form for exporters i.e., Form 1. Additionally, the applicant also has to pay the prescribed fees along with tax payable as applicable by demand draft in favor of Spices Board, Ernakulam

    1. Manufacturer Exporter : Rs.15,000/-  excluding GST

    2. Merchant Exporter : Rs.10,000/- excluding GST

  • If the application is not in the prescribed format or if it does not contain the required information, it might get rejected by the board. Also, the fees submitted to the board is not refundable

  • The application should be accompanied by a certificate or reference from the bank in respect of the financial status of the applicant

  • The regulating authority after inspecting everything, finds it to be correct, then it will issue a certificate with exporting in Form A to the applicant

 

Renewal of Certificate of Registration as Exporter of Spices {CRES}

The validity of certificate of registration is three years from the block period. Any person who wishes to renew their Certificate as Exporter needs to submit an application in the Form-1 to the authority. Also, it is provided that it is liable each month if anyone fails to apply for renewal of their license before its expiry. The renewal fees is same as fresh application fees from the year 2018.

Furthermore, the issuing authority does not accept applications after 31st August. Exporters who fail to apply for renewal of their licenses have to apply for a fresh license/registration after the expiry of their certificate.

It is also provided for the exporters who do not carry on any export business during the period in which he holds a valid certificate, the renewal of a certificate as exporter for the next three years is not considered in such case. However, if such an exporter enters into an export contract, he can apply for a new certificate to the Spices Board.
